White House Press Secretary Jen Psaki is declining to apologize to Border Patrol agents accused of whipping migrants.

Fox News’ Peter Doocy noted on Monday that his outlet has been told that Border Patrol agents accused of whipping Haitian migrants at the border last year have been told they will not face criminal charges.

He asked, “So when is the president going to apologize to them?”

“There is a process and an investigation that’s gone through the Department of Homeland Security, I don’t have an update on that,” Psaki responded.

When Doocy noted whipping would be a “criminal offense,” she interrupted and said, “And there was an investigation into that and I’ll let the Department of Homeland Security announce any conclusion of that investigation.”

Doocy then said, “You accused these officers of brutal and inappropriate measures.”

“Now that they’ve been told they will not be criminally charged, will you apologize to them?”

Psaki said, “Peter, there was an investigation into their behavior. So that investigation is playing out. Whenever it’s going to be announced, the Department of Homeland Security will announce that. And then I’m sure we’ll have a comment on it after that.”

In September, the Department of Homeland Security launched an investigation into Border Patrol agents after a video surfaced that showed officers mounted on horseback attempting to round up migrants who crossed the southern border.

They appeared to be swinging ropes and were accused of whipping the migrants.

At the time President Joe Biden said, “It was horrible, what you see, as you saw, to see people treated like they did, horses nearly running them over, people being strapped. It’s outrageous.”

“I promise you, those people will pay! They will be, an investigation underway now, and there will be consequences. There will be consequences,” he vowed.

For her part, Psaki at the time said officials watched a “horrific video of the CBP officers on horses using brutal and inappropriate measures against innocent people.”

The officers were reportedly using split reins to control their horses, instead of using ropes to whip migrants.
